Fair terms for making art with AI.

The service
Imagine by Tathya is an app from TathyaLabs that turns photos and written descriptions into artwork using an AI image model. By using it you agree to these terms and to the privacy policy. Your use of the app is also subject to the terms of the store you got it from, such as Apple's Licensed Application End User License Agreement.
Imagine is not directed at children under 13.
Your account
Creating images needs a free Tathya account, which also works in other Tathya apps. Keep your password safe and tell us if you think someone else is using your account. You can delete your account at any time from the Account tab.
Your photos and descriptions
You keep the rights you have in the photos and descriptions you submit. You give TathyaLabs permission to store them, process them and send them to our AI providers only to create, show and store your images, as described in the privacy policy.
Only upload photos you own or have permission to use, and only include people who have agreed to it (for a child, their parent or guardian). You are responsible for what you submit and for how you use and share what you create.
What you can't create
Don't use Imagine to create or attempt to create:
- nude, sexual or sexually suggestive images, or any sexualised image of a minor;
- violent, gory, hateful or harassing images;
- realistic fakes of real people, images meant to deceive, or images that impersonate someone;
- copies of a specific living artist's, studio's or brand's work, or anything else that infringes someone's rights;
- anything illegal.
Our server screens requests automatically and the AI provider applies its own safety filters, so some requests will be declined. We may suspend or delete accounts that try to get around these rules.
AI-generated images
Images are generated by AI. Results can be unexpected or inaccurate, may not look like the people in your photo, and may resemble images created for other people. TathyaLabs does not claim ownership of your creations. Depending on where you live, AI-generated images may not be protected by copyright. Don't present a creation as a real photo of a real event.
Free creations and limits
A free account currently includes five creations a day, reset at midnight UTC. Creations that fail are not counted, but deleting a creation does not give it back. We may change daily limits, styles and features as the app improves. There are no in-app purchases in this version.
Acceptable use and availability
Do not misuse the app, overload or interfere with our services, scrape them, or reverse engineer the app where that is prohibited. Imagine needs an internet connection and depends on third-party AI providers, so it may sometimes be slow or unavailable. To the extent allowed by law, the app is provided as available, without guarantees that it will be uninterrupted, error-free or produce a particular result, and TathyaLabs is not liable for indirect or consequential losses arising from its use.
Nothing in these terms limits any rights you have under consumer-protection laws that cannot be excluded by agreement. These terms are governed by the laws of India.
