Welcome to TathyaFit! These Terms of Service ("Terms") govern your use of the TathyaFit mobile application (the "App") and the website located at www.tathyalabs.com (the "Site"), operated by TathyaLabs ("we," "our," or "us").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App or Site.
1. Medical Disclaimer (VERY IMPORTANT)
TATHYAFIT IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE. The App, including its general-wellness estimates and summaries (such as Recovery, Strain, sleep records and duration-match/planning estimates, Wellness Age, 7-Day Goal Consistency, and Personal Pattern Comparisons) and workout tools, is provided for educational and informational purposes only. Wellness Age is an app-defined estimate, not biological, clinical, cardiac, or physiological age; Goal Consistency is target adherence only; and Personal Pattern Comparisons do not establish causation. The App is not intended to diagnose, treat, cure, or prevent any medical condition or guarantee an outcome.
Do not use TathyaFit to make medical decisions. If you have a medical condition, are pregnant, take medication that may affect exercise, or experience concerning symptoms, seek guidance from a qualified healthcare professional. Never disregard professional medical advice or delay seeking it because of information in the App.
2. Assumption of Physical Risk
Physical training, workouts, and lifestyle adjustments carry inherent risks of injury or health complications. By using TathyaFit, you acknowledge and agree that:
- You are voluntarily participating in exercise and activities suggested by the App.
- You are responsible for choosing activity appropriate to your circumstances, using suitable equipment and surroundings, and stopping if you feel unwell or unsafe.
- You assume all risk of injury, illness, or death arising from your participation.
- TathyaLabs is not responsible or liable for any health outcomes or physical damages resulting from suggested workouts.
3. Eligibility and Account
To use TathyaFit, you must be at least 18 years of age (or the age of majority in your jurisdiction). You agree to provide accurate, complete information when creating your profile. You are responsible for keeping your account login details secure.
4. Privacy and HealthKit Integration
Your privacy is central to TathyaFit. Our collection and use of profile, image, location, fitness, and health information is governed by our Privacy Policy. Some HealthKit calculations occur locally and optional cloud sync may store the health or fitness records you choose to sync. HealthKit-derived information is sent to OpenRouter and Microsoft Azure only after you separately allow Coach Health and Fitness Context and confirm the specific Coach read. We do not use HealthKit data for marketing or advertising.
5. AI Features and Nutrition Tracking
Optional nutrition, recipe, Coach, workout-draft, and meal-plan-draft features use OpenRouter, Inc. as the AI gateway and Microsoft Corporation as the Microsoft Azure model-hosting provider only after you separately allow the relevant feature and data scope in the App. Terms acceptance does not itself grant AI-processing permission. Coach health, journal, and memory access are separate from ordinary Coach chat, and proposed Coach data reads and writes require confirmation. Model output can be inaccurate or incomplete, so review it before use and do not treat it as diagnosis, treatment, medical nutrition therapy, exercise clearance, or a medical safety decision. AI analysis of progress photos remains disabled.
6. Subscriptions and Purchases
Paid features may be offered through auto-renewable subscriptions processed by Apple. The App displays localized price, billing period, and any trial eligibility supplied by the App Store before purchase. Payment is charged to your Apple Account when you confirm. Subscriptions renew automatically unless canceled at least 24 hours before the current period ends. You can manage or cancel in your Apple Account subscription settings and restore eligible purchases in the App. Deleting your TathyaFit account or the App does not cancel an Apple subscription.
7. Account Deletion
You can permanently delete TathyaFit from the App's Settings screen. Deletion removes TathyaFit data from our active systems except limited information we must retain for legal, security, fraud-prevention, or dispute-resolution purposes. If your sign-in is also used by another Tathya product, that product's records and the shared authentication identity are preserved; if no other Tathya product uses the identity, the shared profile and authentication identity are deleted as well. TathyaFit deletion cannot be undone.
8. Intellectual Property
The App, Site, and all code, algorithms, visual assets, designs, logos, and written content are the exclusive property of TathyaLabs and are protected by copyright, trademark, and intellectual property laws.
9. Disclaimers and Limitation of Liability
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TATHYALABS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, AND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE APP.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last Updated" date at the top of this page. Your continued use of the App following changes constitutes acceptance of the new Terms.
