Rules of the road (the game one).

The game

Eriksha Rash is a free arcade racing game for iPhone and Android phones, published by TathyaLabs ("we", "us"). By downloading or playing it you agree to these terms and to our privacy policy. If you don't agree, please don't play. Your use of the app is also subject to the terms of the store you got it from: Apple's Licensed Application End User License Agreement on the App Store, or the Google Play Terms of Service on Google Play.

The game is not directed at children under 13.

Your licence to play

We give you a personal, non-exclusive, non-transferable, revocable licence to install and play Eriksha Rash on phones you own or control, for your own non-commercial entertainment. You may not:

• copy, modify, sell, rent or redistribute the game or its art, music or code;
• reverse engineer or decompile it, except where the law allows this despite this restriction;
• cheat, use bots, mods or hacked versions, exploit bugs, or tamper with your progress, sikke or ad rewards;
• interfere with, overload or try to gain unauthorised access to the game or the services behind it.

The in-game "Hack" and "Chori" moves are part of the game. Please keep them there.

Your account

The game creates an anonymous guest account for you automatically. Your progress is linked to that account and saved on your phone. If you delete the app or lose your phone without adding an email address in Settings, we may not be able to recover your progress. If you add an email, keep access to it, because sign-in codes are sent there.

Sikke and virtual items

• Sikke are in-game coins. You earn them by playing, from the daily bonus and from optional reward ads. They cannot be bought.
• Sikke, rickshaws, upgrades, paint jobs, weapons, crate items, XP and ranks have no monetary value. They cannot be sold, traded, transferred, exchanged for money or anything of value, or cashed out.
• You get a limited licence to use them in the game; you do not own them.
• We may adjust, rebalance or reset sikke, prices, rewards and items, for example to balance the game, fix a bug, or remove sikke or items gained by cheating or exploits.
• Because nothing in the game is sold, there is nothing to refund.

Ads

The game is free because it shows ads from Google AdMob. Reward ads are optional: you choose whether to watch one for a reward, such as double sikke for a race, an extra daily bonus or a free crate item. Rewards have daily limits and are given only when an ad finishes playing. Interstitial ads may appear between races, never during one. Ads are provided by Google and its advertisers; we don't control or endorse what they advertise.

Player conduct and driver names

Your driver name must not be offensive, hateful, sexual, abusive, or discriminatory; must not impersonate another person, brand or TathyaLabs; and must not contain anyone's personal information, such as a phone number. We may rename, reset or remove any driver name, and suspend or delete accounts that break these terms or are used to cheat.

When you share a result card, screenshot or invite, you are responsible for where you send it. Please don't spam people.

Fiction, and real roads

Eriksha Rash is cartoon arcade fun. The rash driving, side-slams, lathis, battery theft, hacking, firecrackers and police challans are all fictional, and the characters, rickshaw models and businesses in the game are made up. Real cities and landmarks appear in a stylised, fictional form.

Do not copy anything from the game in real life. On real roads, follow traffic rules and speed limits, respect the police and other road users, and never hit, push, rob or interfere with any vehicle. Never play while driving, riding or crossing the road. Take breaks when you play, and stop if you feel unwell.

Availability and changes

We keep improving the game, so cities, routes, rickshaws, items, prices in sikke, rewards and other features may change, and some may be added or removed. Multiplayer is shown in the game as "Coming soon" and is not available yet; we can't promise when or whether it will launch. Some features, such as saving progress to your account, need an internet connection. We may pause or stop offering the game, and if we do, your progress may no longer be available.

Deleting your account

You can delete your account at any time in Settings > Account > Delete account, or by emailing us as described on the account deletion page. Deletion permanently removes your progress, sikke and items and cannot be undone. You can stop playing at any time by deleting your account and uninstalling the app.

Intellectual property

The game, including its name, logo, code, 3D models, art, music, sound effects and text, belongs to TathyaLabs and is protected by copyright, trademark and other laws. Names of real cities and places are used only to describe the game's settings. Other trademarks belong to their owners.

Disclaimers and limitation of liability

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TATHYALABS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE OR THAT PROGRESS WILL NEVER BE LOST, AND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROGRESS, SIKKE OR VIRTUAL ITEMS, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE GAME.

Nothing in these terms limits any rights you have under consumer-protection laws that cannot be excluded by agreement.

Governing law

These terms are governed by the laws of India. Courts in India have jurisdiction over any dispute about them, without affecting any mandatory right you may have to bring a claim where you live.

Changes to these terms

We may update these terms as the game changes. When we do, we will update the date above. If you keep playing after a change, the updated terms apply.
